General Terms and Conditions

Version 1.0 – October 2026

Article 1 – Definitions

In these terms and conditions, the following definitions apply:

  1. CostaVista: CostaVista B.V., having its registered office in Groningen, registered with the Dutch Chamber of Commerce (KvK) under KvK number 95519882.
  2. Client: any natural person or legal entity who uses the services of CostaVista or contacts CostaVista about them.
  3. Consumer: a Client who is a natural person and is not acting in the course of a profession or business.
  4. Partner: an independent third party with whom CostaVista works, such as an estate agent, financing adviser, property developer, lawyer, notary or property manager.
  5. Services: guiding the Client through exploring, selecting and purchasing property in Spain, providing information and coordinating contacts with Partners, as well as any separately agreed services.
  6. In Writing: by letter or email.

Article 2 – Applicability

  1. These terms and conditions apply to every offer made by, and every agreement concluded with, CostaVista.
  2. Deviations apply only if they have been agreed In Writing.
  3. The Client's general terms and conditions do not apply.
  4. Partners work under their own terms and conditions. Those terms and conditions govern the legal relationship between the Client and the Partner.

Article 3 – Nature of the Services

  1. CostaVista guides the Client through exploring and purchasing property in Spain and acts as the point of contact throughout the process.
  2. CostaVista is not a seller and is not a party to the purchase agreement, the financing agreement or any other agreement that the Client concludes with third parties.
  3. Viewings, negotiations on behalf of the seller, financing, legal checks and the execution of the deed are handled by Partners or by other professionals whom the Client engages directly. Each Partner is itself responsible for its own work.
  4. CostaVista's obligation is an obligation to use reasonable endeavours (an obligation of means, not of result). CostaVista does not guarantee that a purchase will be completed or that a property will meet the Client's expectations.

Article 4 – No advice

  1. CostaVista does not provide legal, tax or financial advice, nor investment advice. Information provided by CostaVista is general in nature and is not a substitute for advice from an expert.
  2. CostaVista recommends that, before the purchase, the Client engages an independent Spanish lawyer (abogado) to carry out the legal checks on the property and, where necessary, a tax adviser in Spain and in the Client's country of residence.
  3. The Client makes his own decisions, based on his own assessment.

Article 5 – Information about properties and the market

  1. Information about properties, such as prices, floor areas, features, rental possibilities and permits, originates from sellers, property developers or Partners. CostaVista passes this information on with care but does not guarantee its accuracy or completeness.
  2. Price indications, yield indications and other market data are estimates. They offer no guarantee of future results.
  3. No rights may be derived from the information on the website or in other communications of CostaVista.

Article 6 – Fees

  1. CostaVista always discusses with the Client in advance how the fee for its Services is structured.
  2. In certain cases, CostaVista receives a fee from a third party, for example a property developer or another Partner. In that case, CostaVista does not charge the Client for its guidance, unless otherwise agreed In Writing.
  3. In other cases, CostaVista provides a separate service and charges the Client a fee for it. That fee is payable only if the Client has agreed In Writing to the engagement and the rate in advance.
  4. Rates for Consumers include VAT. Invoices must be paid within fourteen days of the invoice date, unless otherwise agreed.
  5. The costs of Partners and other third parties, such as estate agent's commission, lawyer's and notary's fees, registration, taxes and financing costs, are not included in CostaVista's fee and are borne by the Client to the extent that, under the relevant agreement or by law, they are payable by the buyer.

Article 7 – Obligations of the Client

  1. The Client provides CostaVista in good time with the information needed for proper guidance and warrants that it is accurate.
  2. The Client assesses for himself, with the help of experts where necessary, whether a property, a financing arrangement and an agreement are suitable for him.

Article 8 – Right of withdrawal

  1. If a Consumer concludes an agreement with CostaVista at a distance for which a fee is payable, the Consumer may cancel that agreement within fourteen days of its conclusion without giving any reason.
  2. If the Consumer has expressly requested that the Services begin within that period, he owes, upon withdrawal, a proportionate part of the fee for the services already performed. If the service has been performed in full with the Consumer's consent, the right of withdrawal lapses.
  3. The Consumer may notify CostaVista of the withdrawal In Writing.

Article 9 – Liability

  1. CostaVista is liable only for direct damage resulting from an attributable failure in its own Services.
  2. CostaVista's liability is limited to the amount of the fee that the Client has paid to CostaVista for the engagement concerned. If the Client has not paid any fee to CostaVista, liability is limited to €2,500.
  3. CostaVista is not liable for damage resulting from any act or omission of Partners or other third parties, or from inaccurate or incomplete information provided by them.
  4. CostaVista is not liable for indirect damage, including loss of profit, loss of rental income and loss of value.
  5. The limitations in this article do not apply if the damage was caused by intent or deliberate recklessness on the part of CostaVista. As regards Consumers, they do not apply to the extent that the law does not permit them.

Article 10 – Privacy

CostaVista processes personal data in accordance with its privacy statement, which is published on the website.

Article 11 – Intellectual property

The texts, design and other content of CostaVista's website and documents may not be reproduced or made public without prior permission In Writing, except for personal, non-commercial use.

Article 12 – Complaints

  1. The Client must report any complaint about the Services to CostaVista In Writing as soon as possible, with a clear description.
  2. CostaVista responds within fourteen days of receipt. If more time is needed, CostaVista informs the Client within that period when a substantive response can be expected.

Article 13 – Governing law and competent court

  1. All agreements with CostaVista are governed by Dutch law.
  2. Disputes are submitted to the competent court in the district of Noord-Nederland (Netherlands). A Consumer may also submit the dispute to the court that has jurisdiction by law.
  3. A Consumer who lives in another country retains the protection afforded to him by the mandatory provisions of the law of that country.

Article 14 – Final provisions

  1. CostaVista may amend these terms and conditions. The amended terms and conditions apply to agreements concluded after their publication.
  2. These terms and conditions are available in Dutch, English, German and Spanish. In the event of any difference in interpretation, the Dutch text prevails.
